JPMorgan case shows why energy trading schemes are chronic problem

We all know what corporate law firms are for, right? To represent their clients' interest fairly and professionally, of course. To obfuscate, obstruct, delay, misdirect ? sometimes that too.

So the saga of JPMorgan Ventures Energy Corp. and a slick little two-step it engaged in with its two law firms to fend off the Federal Energy Regulatory Commission bears exceptional interest, not least because its outcome may hint at a new approach to enforcement by that long-overmatched agency.

To put things in a nutshell, JPMorgan's electricity trading operation was accused of bid-rigging by the California Independent System Operator, which manages much of the state's wholesale power market through regular auctions. We explained in an earlier column how the alleged scheme in 2010 and 2011 may have cost California ratepayers as much as $200 million.

FERC duly launched an investigation of JPMorgan's trading, which will take months at least and could cost the firm a maximum of $1 million for every day it's found to have violated trading rules. Given that revenue of $14 billion a year flows into the JPMorgan division that houses the energy trading unit, that fine wouldn't count for much more than a rounding error.

That may be why manipulation seems to be a chronic disease of the California wholesale electricity market ? and of those in other regions. For example, FERC has accused Deutsche Bank's energy trading arm of bogus bidding in the California market and threatened it with a $1.5-million penalty. Deutsche Bank has until Oct. 19 to respond to the allegations.

JPMorgan, which doesn't own a power plant in California but has trading rights to the output of 10 Southern California generating stations, keeps FERC and the California ISO on their toes all by itself. In 2011, days after ISO closed the original loophole it says Morgan exploited, the firm found another one, according to ISO filings. That chicanery cost ratepayers $5.3 million over just five days, ISO said.

Just last month, JPMorgan was alleged to have exploited yet two more loopholes in the trading rules, which may have garnered the firm nearly $10 million in possibly excessive payments. The California ISO is currently withholding $3.7 million from the firm, apparently to cover its losses. FERC hasn't launched an investigation of that trading, and Morgan has said it has done nothing wrong.

This month FERC opened a new front in this battle. The commission charged that JPMorgan, with the assistance of its lawyers, gave it the runaround when it asked for financial information in connection with its investigation. According to FERC public documents, JPMorgan dodged the request for months and then provided misleading and incomplete information.

How ticked off is FERC? It's proposing not to fine JPMorgan over the information exchanges, but to suspend its right to participate in the California auction. To an electricity trading firm, that's a nuclear attack. The last electricity wholesaler that got its trading rights revoked was Enron ? after it went bankrupt.

If FERC follows through, JPMorgan would still be allowed to sell electricity in California, but would be allowed only to collect its costs plus a nominal profit. That's likely to be a fraction of what it could make by bidding in the open auction, and it could drive JPMorgan out of the market.

"When a company is faced with significant sanctions, not just a financial slap on the wrist, it's going to take it seriously," says Tyson Slocum, director of the energy program at the Washington public interest group Public Citizen. "No longer is a violation just a calculated risk, and a cost of doing business if they get caught."

JPMorgan will have until mid-October to respond to FERC's show-cause order, which asks why the firm's bidding rights shouldn't be suspended. So let's take a closer look at its alleged subterfuge.

The case began May 4, 2011, when the California ISO, as part of the investigation into the bidding allegations, asked JPMorgan for trading and other financial data related to its trading in the California wholesale market. Morgan was to comply by May 18. On deadline day, Morgan's lawyers wrote back, telling ISO in essence to stuff it. They pointed to a regulation stating that once ISO referred its accusations against Morgan to FERC, ISO lost its right to demand any data from Morgan. The lawyers repeated that position in two letters in June.

JPMorgan did provide ISO with some of the data it requested, but waited until as long as 162 days after the deadline. (It said it was doing so "voluntarily.") In February, the fed-up ISO fined Morgan $486,000 for the delay.

JPMorgan then filed its own complaint with FERC, stating in essence that it was being harassed by ISO. It noted that the rule clearly states that once a matter is in FERC's hands, ISO "shall not undertake any investigative steps," which include issuing demands for information. Morgan asked FERC to overrule the "unreasonable" $486,000 penalty.

Here's the punch line. Morgan flagrantly misrepresented the rule, which says, in its totality, that ISO can't "undertake any investigative steps except at the express direction of FERC."

Moreover, FERC indeed had given ISO that "express direction." The commission had notified JPMorgan in writing that it had done so, via two separate emails to JPMorgan's lawyers at the Washington firm of Sutherland, Asbill & Brennan. And Sutherland had acknowledged receiving them, also in writing.

All this was laid out in a filing by FERC's enforcement staff June 19. The staff accused JPMorgan of misleading the commission about the "express direction" rule, and called the firm's claim that it never knew ISO was acting at FERC's direction a lie.

Within days after the staff blew the whistle, JPMorgan fessed up. It admitted that there was "a factual error" in its original complaint and swore that it hadn't intended to mislead FERC. It explained that the attorneys at Sutherland had forgotten all about the emails they'd received from the commission in 2011, so they hadn't mentioned them to attorneys at Skadden, Arps, Slate, Meagher & Flom, who had drafted JPMorgan's complaint to FERC.

Morgan also pledged to withdraw its complaint posthaste. "We hope this ? shows that we acted in good faith at all times with no intent to mislead anyone," the Skadden Arps lawyers told the commission, as if to plead no harm, no foul.

The lack of USB 3.0 connectivity is undoubtedly the only drawback of the Ultralife Hub, and the primary distinction between the Ultralife Hub and the Satechi 3.0.

Setting up the Ultralife Hub simply requires plugging it into one of your system's USB ports. It works just as expected, and I experienced no performance degradation when transferring our 1.22GB test folder. Like the Satechi 3.0, the Ultralife Hub is compatible with Windows and Mac operating systems.

Overall, the Targus Ultralife USB Hub with Ethernet Port is a great choice for anyone looking to expand their USB 2.0 connectivity or who wants an Ethernet port in an attractively designed and highly portable package. The choice ultimately boils down to either the Satechi 3.0 and the Ultralife Hub. While both sport the same price tag, the Satechi 3.0 gives your system three additional USB 3.0 ports versus the Ultralife Hub's two additional USB 2.0 ports. The Ultralife Hub features an Ethernet port and, unlike the Satechi 3.0, doesn't require an external power supply, thereby making it far more portable. Still, we ultimately prefer function over form, and for that reason the Satechi 3.0 retains its edge over the Ultralife Hub.

Grow Community: Evergreen homes | MNN - Mother Nature Network


After going on summer hiatus last month, I?m back with a noteworthy edition ?Evergreen homes? ? a monthly series of posts in which I break out the geographical bias and spotlight green residential building projects from my home state of Washington ? that spotlights a sustainable community that?s well, grown, since I last wrote about it.

At the time, all I had to share about the 8-acre ?pedestrian-oriented, energy-efficient, multigenerational neighborhood? were early renderings and a few key highlights (Community composting facilities! P-Patches! Kayak storage! Minimal parking spaces!). Perhaps one of the more intriguing aspects of Grow ??geared to be the largest solar-ready planned community in Washington, by the way ??is the fact that it?s the first residential project in the U.S. to be endorsed by One Planet Living's?Communities program, a rigorous, 10-tier certification program developed by U.K. nonprofit?BioRegional Development Group?and WWF International?that focuses on the greenness of neighborhoods?instead of individual homes.

Now, three of the Asani-developed community?s first three prefab panelized model?homes ??the Everett, the Aria, and the Ocean?? have been installed and are open for tours. These three prefab lovelies will be later joined by two additional home designs, the Tallis and the Dashwood, and a series of rowhouse rentals dubbed the Copper. In total, there will eventually be 50 single-family homes and 81 rental apartments spread throughout the development in ?micro-neighborhoods? ??small clusters of buildings centered around shared green spaces and community gardens that are connected by a network of trails winding throughout the community.?

Davis, a U.K.-born Frank Gehry alum, relayed to me in an email now that the three first model homes are complete as part of the first 3-acre phase, work will begin next month on the larger second phase: two 10-unit rowhouse apartments and 21 single-family homes. In future phases, the remaining homes and a community center will be constructed.


Prices for the homes begin in the low $300,000s. This is on the affordable side of things considering Bainbridge Island's median home value is $539,000. At 1,846 square feet, the Everett is the largest of the model homes and features three bedrooms, a mudroom (very important in this geographic location), a study, and playroom/office space. The 1,573-square-foot Ocean includes two master bedrooms (or one master bedroom and two smaller rooms upstairs) and roof deck. Designed for downsizing couples or small families, the 1,549-square-foot Aria includes two bedrooms, a study, and a master closet large enough to turn into a nursery or home office.

Each super-insulated (R-38 for the walls and R-60 for the ceilings) home includes a detached storage shed, energy-efficient appliances including induction cook ranges, heat-recovery ventilators, low-flow fixtures, ductless mini-split heat pumps, high-performance windows from Marvin, low-VOC paints and finishes, and the use of locally sourced, sustainable materials throughout. Each home is also (mostly) PVC-free. Plus, to achieve net-zero status, there?s the option to install grid-tied photovoltaic arrays ??manufactured in Washington by?BlueFrog Solar, nonetheless ??to the roofs.

The overall vibe of Grow Community is low-impact, low-key, and centered around ?five-minute living." In addition to an emphasis on community gardening, residents will have access to both car share (Nissan Leafs, natch) and bike share programs. The shops, cafes, and other amenities of Winslow (AKA downtown Bainbridge Island) are just a short bike ride or walk away ??thus, the ?five-minute living? concept ??and downtown Seattle's Pier 52 can be reached via a 35-minute ferry ride from Winslow. Having done the Bainbridge/Seattle ferry trek a handful of times before, I can say there?s no better way to decompress after a long day in the office than crossing the Puget Sound during sunset. It?s nothing short of magical.

Overall, the goal of Grow Community is two-fold:

? To create an intentional urban community that enhances the quality of life of its residents by making sustainable lifestyle choices both accessible and cost effective.

? To demonstrate that net-zero energy homes, built with sustainable materials can be constructed and sold at a price point that is replicable on a large scale.

Nothing fishy about fish oil fortified nutrition bars

ScienceDaily (Sep. 27, 2012) ? In today's fast-paced society, consumers often reach for nutrition bars when looking for a healthy on-the-go snack. A new study in the September issue of the Journal of Food Science published by the Institute of Food Technologists (IFT) found that partially replacing canola oil with fish oil in nutrition bars can provide the health benefits of omega-3 fatty acids without affecting the taste.

Producers have been hesitant to incorporate fish oil into foods because it tends to give off a fishy taste or smell, therefore requiring additional processing steps to eliminate these unwanted qualities. In the study, four levels of fish oil were evaluated to determine consumer acceptance of fish-oil fortified nutrition bars. The results showed that oat and soy-based nutrition bars fortified with the lowest replacement level (20 percent) of fish oil did not affect consumer acceptance or purchase intent.

Omega-3 fatty acids from fish oil are known to lower triglyceride levels and may help with rheumatoid arthritis.

Deadly complication of stem cell transplants reduced in mice

ScienceDaily (Sep. 27, 2012) ? Studying leukemia in mice, researchers at Washington University School of Medicine in St. Louis have reduced a life-threatening complication of stem cell transplants, the only curative treatment when leukemia returns.

About 50 percent of leukemia patients who receive stem cells from another person develop graft-versus-host disease, a condition where donor immune cells attack the patient's own body. The main organs affected are the skin, liver and gut. Now, the scientists have shown they can redirect donor immune cells away from these vital organs. Steering immune cells away from healthy tissue also leaves more of them available for their intended purpose -- killing cancer cells.

"This is the first example of reducing graft-versus-host disease not by killing the T- cells, but simply by altering how they circulate and traffic," says John F. DiPersio, MD, PhD, the Virginia E. and Sam J. Golman Professor of Medicine. "Donor T-cells do good things in terms of eliminating the recipient's leukemia, but they can also attack normal tissues leading to death in a number of patients. The goal is to minimize graft-versus-host disease, while maintaining the therapeutic graft-versus-leukemia effect."

The study is now available online in Blood.

Working with mice, Jaebok Choi, PhD, research assistant professor of medicine, showed that eliminating or blocking a particular protein -- the interferon gamma receptor -- on donor T-cells makes them unable to migrate to critical organs such as the intestines but still leaves them completely capable of killing leukemia cells.

"The fact that blocking the interferon gamma receptor can redirect donor T-cells away from the gastrointestinal tract, at least in mice, is very exciting because graft-versus-host disease in the gut results in most of the deaths after stem cell transplant," DiPersio says. "People can tolerate graft-versus-host disease of the skin. But in the GI tract, it causes relentless diarrhea and severe infections due to gut bacteria leaking into the blood, which can result in severe toxicity, reduction in the quality of life or even death in some patients."

Long known to be involved in inflammation, the roles of interferon gamma, its receptor and their downstream signaling molecules are just beginning to be described in the context of graft-versus-host disease, says DiPersio, who treats patients at Siteman Cancer Center at Barnes-Jewish Hospital and Washington University School of Medicine.

The cascade begins when interferon gamma activates its receptor. The interferon gamma receptor then activates molecules known as JAK kinases, followed by STAT, and finally CXCR3. CXCR3 mediates the trafficking of donor T-cells to the GI tract and other target organs.

Since deleting the interferon gamma receptor from donor T-cells directs them away from target organs, the researchers asked whether they could produce the same beneficial effects by inhibiting some of the receptor's downstream signaling molecules. Indeed, Choi also found that knocking out CXCR3 reduces graft-versus- host disease, but not completely.

"There are probably additional downstream targets of interferon gamma receptor signaling other than JAKs, STATs and CXCR3 that are responsible for T-cell trafficking to the GI tract and other target organs," DiPersio says. "We're trying to figure out what those are."

To move their findings closer to possible use in humans, Choi and DiPersio also showed that they could mimic the protective effect of deleting the interferon gamma receptor with existing drugs that block JAK kinases. In this case, they tested two JAK inhibitors, one of which is currently approved by the U.S. Food and Drug Administration to treat myelofibrosis, a pre-leukemic condition in which the bone marrow is replaced with fibrous tissue.

While they showed that JAK inhibitors are effective in redirecting donor T-cells away from target organs and reducing graft-versus-host disease in mice with leukemia, they have not yet tested whether these drugs also preserve the desired anti-leukemia effect.

"The proof-of-principle behind these experiments is the exciting part," DiPersio says. "If you can change where the T-cells go as opposed to killing them, you prevent the life-threatening complications and maintain the clinical benefit of the transplant."

To many above the Mason-Dixon line, the Confederate flag is a symbol of a divided country and an empathy with slavery and racism. To many below it, however, the "Rebel" flag is a symbol of unity, heritage and standing up for state's rights. To Lynyrd Skynyrd, it's all part of the band's brand -- good-time Southern rock ("Sweet Home Alabama") made by men with flowing locks and cranked-up guitars -- and it's made an appearance at virtually every one of their shows since they formed in the 1960s.?

But as band members learned recently, it's not so easy to lower the flag.?

It all started on Sept. 9, when three members of the band (Gary Rossington, Rickey Medlocke and Johnny Van Zant) appeared on CNN to discuss their new album, "Last of a Dyin' Breed." Toward the end of the discussion, interviewer Fredricka Whitfield asked about the band appearing to disassociate themselves from the flag.

"It became such an issue about race and stuff where we just had it in the beginning because we were Southern, and that was our image back in the'70s and late '60s ... but I think through?the years, people like the KKK and skinheads and people kind of kidnapped the Dixie or Rebel flag from the Southern and the heritage of the soldiers," explained guitarist and sole original band member Rossington. "We didn?t want that to go to our fans or show the image like we agreed with any of the race stuff or any of the bad things.?

That didn't go well with some fans; messages left on the CNN board indicated they felt that leaving the flag out of the routine was a slap in the face and kowtowing to political correctness. "By ignoring and denying the flag that is part of their history, they are leaving a large segment of their fan base behind," wrote G.D. Smith on the boards. "It's a shame that money is now more important than honor or heritage."

"We hope you never come back to 'Sweet Home Alabama,'" wrote another fan, L.E. Thompson.

Well, never let it be said that Skynyrd isn't responsive to its fans; last Friday, Rossington posted a message on the band's website to "clarify the discussion of the Confederate Flag" in the interview, writing:

"Myself, the past members and the present members (that are from the South), are all extremely proud of our heritage and being from the South. We know what the Dixie flag represents and its heritage; the Civil War was fought over States rights.

And based on the comments left on the website following that post, this is an issue that remains still unresolved -- but many are backing up his decision to try and find a balance.

"I think all of us do well to let our conscience be our guide, and Mr. Rossington has given an example," wrote Walk In My Shadow.

And, added Toolbox, "Lynyrd Skynyrd is a true American band and are proud of their Southern heritage. Do you think for one minute that they would denounce their Southern roots?? Your wrong. Just listen to their music."

"It's an extremely shameless court," Ai, whose 81-day detention last year sparked an international outcry, told reporters.

"It didn't respect the facts or give us a chance to defend ourselves; it has no regard for taxpayers' rights," he said, adding he did not know whether now he had to pay to entire fine though he suspected he did.

Ai, 55, had asked the?Chaoyang District Court?to overturn the city tax office's rejection of his appeal against the 15 million yuan ($2.38 million) tax evasion penalty imposed on the company he works for, Beijing Fake Cultural Development Ltd, which produces his art and designs.

"From the Fake tax case (we) can see that there's no fair justice in?China," Ai added.

The case is widely seen by activists as an attempt to muzzle the outspoken artist, who has repeatedly criticised the Chinese government for flouting the rule of law and the rights of citizens.

Courts, controlled by the ruling?Communist Party, rarely accept lawsuits filed by dissidents and appeals against official decisions are routinely dismissed.

The case comes on the heels of a score of other high-profile cases, including the fleeing to the?U.S. embassy?of blind, self-taught legal activist?Chen Guangcheng.

Government efforts to silence Ai have frequently backfired, as demonstrated by an outpouring of public sympathy - and cash - in response to the tax penalty.

About 30,000 people donated money to help Ai cover an 8.45 million yuan bond required to contest the tax charges. Many of Ai's supporters folded money into paper planes that were flown over the walls of his home.

Vegan Teens Tell Us How They Manage Meals ? FeelGood Natural ...

To live the vegan lifestyle ? to have a diet that excludes all animal products and byproducts entirely ? is not an easy choice to make.

It is often a challenge to find meals at restaurants, the general public can be less than understanding and nutritional goals (like getting enough protein each day) must become a central focus of a teenager?s diet. But, for many young adults who make the decision to give up all meat and dairy products, the pros far outweigh any inconveniences they might encounter along the way.

?I absolutely feel healthier,? said Jodie Saunders, 18, a freshman at University of Washington in St. Louis and Lancaster native. ?Initially, the transition (to a strictly vegan diet) was extremely difficult. I missed certain foods a lot, especially meat. But after a few weeks I noticed I had a lot more energy and my mood improved a lot. Now I can?t imagine not being vegan. Feeling better is why I keep with it.?

This feeling of improved health is common among teens who chose to make the switch. The diet of a teenager is sometimes filled with heavy foods, like pizza, ice cream and other delicious, but not very healthy, options. More often than not, veganism forces people to focus much more closely on their intake of a variety of vitamins and nutrients than they otherwise would.

?Becoming a vegan was just another way for me to control what I put in my body. I already run and exercise a lot, so why not become as healthy as I can be in this way, too?? said Jordan Swartz, 22, originally from Lancaster.

?Almost immediately, I felt more refreshed, like I was feeding my body healthier things,? said Gaby Dannehl, 17, a senior at Lancaster Country Day School.

So if you absolutely cannot eat any animal products, what exactly are these healthier foods being mentioned?

Vegan teenagers often have to be very creative with their daily meals, planning their food intake in advance, as well as constantly researching unique and filling vegan foods and recipes. Swartz refers to ?Veganomicon: The Ultimate Vegan Cookbook? by Isa Chandra Moskowitz and Terry Hope Romero as the ?vegan bible? and uses it, as well as other cookbooks and Internet sources, to ?plan and cook every meal for the rest of the week on Sundays.?

?Every day for breakfast I would have spinach protein smoothie,? Dannehl said. ?Lunch was either a salad or a sandwich on Ezekiel bread. For dinner, another salad and lots of vegetable stir-fry with soba noodles.?

Saunders counts sushi, oatmeal, granola, pasta and, of course, lots of fruit and vegetables as the staples of her daily diet. Other popular vegan foods include black bean burgers, hummus, tempeh (a patty-like soy product), seitan (a high-protein, wheat-based food, often used as a meat substitute due to its similar texture and appearance), sturdy, leafy greens like kale, and more beans than most people can even imagine.

Finding a quick snack or junk food that fits a vegan diet is often incredibly difficult if it is not planned in advance.

?I snack on peanuts or almonds, and I have fruit throughout the day,? said Saunders in an email. But not all of her on-the-go foods are healthy. ?I love Oreos! They are vegan and I am so glad! Low- fat Chex Mix is also vegan, as well as certain types of ?butter? popcorn. Most movie theaters use fake butter.?

For a quick and vegan-friendly midday pick-me-up, a venti-sized soy cafe latte from Starbucks can do the trick; it is packed with 11 grams of protein. Seeds (pumpkins, sunflower, flax, etc.) and nuts (peanuts, almonds, etc.) also prove to be very popular snacks with the vegan crowd, as are dairy-free pretzels, kale and sea salt chips, and Twizzlers and Swedish Fish candies.

Public reactions to teen veganism are quite varied. Some teenagers report having parents with an aversion to their diet, who see it as a passing phase, while others, like Saunders, made the change along with the rest of their family.

?At the end of my eighth-grade year, my parents read a nutrition book called ?The China Study? by Dr. Colin Campbell, and decided to make a permanent change to a vegan diet,? she said. ?The book explores the correlation between nutrition and heart disease, diabetes and cancer, and how a vegan diet has the ability to greatly reduce the risk of these illnesses.?

The opinions of friends and family matter, but so, it seems, do those of strangers.

?It?s difficult for people to relate to why I?m vegan,? Saunders said.

Not all reactions, however, are negative.

?I also talk to people who really admire my being vegan and how challenging it can be,? Saunders said.

Another troublesome aspect of maintaining a vegan diet is something that many teens love to do with their friends ? going out to eat at a restaurant. Many eateries are able to offer vegan fare, but are not particularly thrilled about doing so.

?I was always able to find a few things on the menu,? said Dannehl. ?But sometimes I had to ask for a meal to be prepared differently.? Saunders finds the search for vegan food to be a challenge. She said, ?If a restaurant isn?t vegan-friendly, it?s always a little embarrassing to ask for special treatment,? a very popular opinion among teenagers.

However, there are options here in Lancaster for vegan food.

?I love On Orange (in downtown Lancaster.) They have spicy vegan sausage, vegan pancakes that are incredible and tofu scrambled eggs,? Saunders said.

?Roburrito?s is great and opening a location in Lancaster soon. They offer potatoes to replace the meat usually found in burritos, and it?s run by a bunch of punk dudes, so they?re really conscious about keeping the restaurant vegan-friendly,? Swartz said.

Senorita Burrita offers vegetable burritos and soy sour cream. Cravings Gourmet Deli also will work with you to build your own vegan sandwich.

For a swankier night out, Simpson recommends The Dispensing Company and Ma(i)son in downtown Lancaster. And for something sweet, The Flour Child in Columbia has vegan cakes and desserts.

?There are so many easy options available that there?s really no excuse not to be a vegan,? Swartz said. And don?t worry about making dietary blunders; as Simpson said, ?You make mistakes all the time. After using non-dairy creamer for three weeks, I found out that there is milk in it. You learn. If you let every mistake stop you from committing to a vegan diet, you?ll never actually get anywhere.?

'Dangerous' prison escapee captured in Georgia

Michael Dowda, the escaped inmate from the Mississippi State Penitentiary that officials described as "armed and dangerous," has been captured, prison officials said Tuesday.

Dowda, 48, who had been at large since Saturday was apprehended in Macon, Ga., nearly 500 miles away from the Mississippi state prison in Parchman, Miss.

Through investigations by the Mississippi Department of Corrections (MDOC) and U.S. Marshals in Mississippi and Georgia, Dowda was captured at approximately 12:30 a.m. Tuesday, MDOC Spokesperson Tara Booth said in a statement.


Dowda now faces extradition to Mississippi and multiple charges including escape.

While on maintenance detail, Dowda allegedly broke into a safe inside the home of a Department of Corrections employee on prison grounds and stole two handguns. He then fled the prison grounds driving a white 2005 Chevrolet Silverado truck that he also stole from the same employee.

The prison was placed on lockdown and closed to visitors after his escape.

Dowda is serving a life sentence for murdering his girlfriend, Clarissa Lynn Jarrett, during an argument on Nov. 13, 1996. After Jarrett said she had sex with other men, Dowda got a gun, put it to her head and pulled the trigger, the Associated Press reported. He later said he had removed the clip and thought the gun was unloaded, but authorities said one bullet was chambered.

He chose to be tried without a jury. A judge convicted him in December 1998, and he began serving his sentence at the state prison in January 1999.?

There was no record of any previous escape attempt by Dowda from any Mississippi Department of Corrections facility.

The last escape at Parchman occurred in April 2008, officials said.? Inmate John Compton, who went missing during farming operations, was captured five days later by police in Texas.

Spain prepares for more painful austerity

MADRID (Reuters) - Spain will announce another round of unpopular austerity measures in a 2013 budget on Thursday, already prompting protests from a public battered by attempts to put the country's finances in order.

With this year's budget deficit target looking untenable, the conservative government is now looking at such things as cuts in inflation-linked pensions, taxes on stock transactions, "green taxes" on emissions or eliminating tax breaks.

The 2013 budget is the second one conservative Prime Minister Mariano Rajoy has had to pass since he took office in December. It must persuade Spain's European partners that it can cut the budget shortfall by more than 60 billion euros by 2014.

Rajoy has already passed spending cuts and tax hikes worth slightly more than that over the next two years, but half-year figures show the 2012 deficit target slipping from view as tax income forecasts will not be hit due to economic contraction.

Spain is at the centre of the euro zone debt crisis on concerns the government can't control its finances and those of highly-indebted regions, bitten by a second recession since 2009 which has put one in four workers out of a job and pushed up borrowing costs.

Protests against the cuts are gaining pace. More than 1,000 police barricaded Parliament in Madrid on Tuesday against protesters who planned to form a human chain around the building later in the evening.

Hundreds of demonstrators gathered in different points of the capital before marching to Parliament, saying they were angry that the state has poured public funds into crumbled banks while it is cutting social benefits.

"We're protesting against the cuts. I've had to give up my apartment," said Ondina, a 30-year-old fine arts graduate who is without a job. She said she can't survive on an unemployment benefit of 260 euros ($340) a month.

On the regional front, Catalonia, which generates about 20 percent of the national output, announced on Tuesday it would hold early elections on November 25 after its call for more tax autonomy was rejected last week by Rajoy.

Mounting political uncertainty in cashstrapped Catalonia, along with an announcement from southern region Andalucia that it was mulling seeking a 4.9 billion euros credit line from the central government, will pile more pressure on Madrid to seek European aid.

Rajoy is holding back from applying for help, which would activate a European Central Bank bond-buying program and bring down Spain's punishing debt premiums.

With the threat of the plan alone reducing 10-year yields by around 2 percentage points, the cautious leader, known for keeping his cards close to his chest, is playing for time.

Rajoy says he is mulling the conditions of a bailout application, but suspicion that he may wait until after regional elections October 21, pushed short-term yields higher at auction on Tuesday.

The government is also expected to set a fresh timetable for economic reforms, on Thursday or Friday, seen as an attempt to pre-empt strict EU-imposed conditions for aid, and help the conservatives save face at home.

RUNNING OUT OF OPTIONS

Half-year deficit data indicate national accounts are already on a slippery slope that will drive Spain into a bailout.

The deficit to end-June stands at over 4.3 percent of gross domestic product, including transfers to bailed out banks, making meeting the 6.3 percent target by the end of the year almost impossible.

On Tuesday, the treasury ministry said the central government deficit to end-August had reached 4.77 percent of GDP, already above its year-end target of 4.5 percent of GDP.

"Its going to be difficult keeping the deficit to around 2 percent in the second half, when the first half was closer to 4 percent, especially since traditionally, the second half deficit is higher than the first," said Juan Ignacio Conde-Ruiz, economist at Madrid's Complutense University.

For 2012, the measures aim to reap savings of over 13 billion euros, but economists see the deficit missing the target by almost 1 percentage points implying further saving needs of up to 10 billion euros for this year alone.

Rajoy has been careful to highlight the importance of next year's deficit target of 4.5 percent of GDP though any shortfall this year will have to be carried through and will weigh on 2013's accounts.

After slashing civil servants' wages, raising value added tax by 3 percentage points - the main VAT has gone from 16 percent to 21 percent since 2010 - and cutting health and education spending, Rajoy is running out of options.

More than 60 percent of government spending goes to pensions, unemployment benefits and servicing debt, making further cuts on the revenue side difficult without hitting 6 million jobless people.

Sources say the conservatives are studying eliminating, or at least limiting, the inflation-linked raise in pensions, which account for around a quarter of all spending.

On Tuesday Deputy Prime Minister Soraya Saenz de Santamaria repeated Rajoy's pledge that the government would make changes to the pension system only as a last resort, despite recommendations by Brussels.

Under current rules the government must raise pensions in line with inflation in November, but Rajoy has been underdone by his own austerity measures as the VAT hike is seen pushing prices up by more than 3 percent.

This VAT effect on consumer prices will cost the government an extra 3.5 billion euros in pensions costs, Conde-Ruiz says, wiping out the 2.5 billion euros it hopes to raise this year by increasing the sales tax.

Further snips to public servants' wages, which have seen purchasing power fall by over 25 percent due to cuts by the former Socialist government and Rajoy, could fuel protests.

Other potentials savings include deeper cuts to the ministries, taxes on stock market transactions and so-called "green taxes" on greenhouse emissions, but in they themselves aren't enough to cover the potential shortfall.

However, a selective reduction of tax breaks could raise as much as 6 billion euros, according to economists.

"A massive pruning of these incentives could easily bring Spain another six billion euros," said Juan Jose Rubio Guerrero, president of the Independent Forum of Fiscal Analysts. (0.7743 euros)
